Consumer Credit Law ("CCL", "we", "us", "our") respects your privacy and is committed to protecting your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy explains what we collect, how we use it, who we share it with, and the rights you have. CCL is a specialist consumer credit law consultancy. We are not a law firm or a firm of attorneys and we do not provide legal representation; where litigation is required, it is conducted by our independent affiliate attorneys.

  • Financial and credit information — details of your credit agreements, arrears, accounts, credit bureau data, summonses, notices, and related documents you share with us so we can assess and assist your matter.
  • Documents you provide — such as a signed Power of Attorney, account schedules, and correspondence.
  • Technical information — such as your IP address, browser type, and pages visited, collected automatically when you use our website.

3. How we collect your information

We collect information directly from you when you complete a form on our website, message us on WhatsApp, request a credit report, sign a Power of Attorney, or otherwise communicate with us. We also collect technical information automatically through cookies and analytics tools, and we may obtain credit information from registered South African credit bureaus where you have requested a credit report or assessment.

4. Why we process your information

We process your personal information to assess your credit and legal position and provide the services you request; to communicate with you about your matter; to instruct our independent affiliate attorneys where litigation is required; to obtain and provide credit reports where requested; to process payments for our services; to comply with our legal and regulatory obligations; and to improve our website and services.

5. Legal basis for processing

We process your information on the basis of your consent, the performance of our agreement with you, our legitimate interests in operating and improving our services, and compliance with the law, as permitted by POPIA.

6. Who we share your information with

We do not sell your personal information. We may share it with:

  • our independent affiliate attorneys, where your matter requires litigation;
  • registered credit bureaus, where you have requested a credit report or assessment;
  • trusted service providers who help us operate — such as our website host, payment processor, and analytics providers — under appropriate confidentiality safeguards; and
  • regulators, courts, or authorities where we are required to do so by law.

7. Storage and security

We take reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, and misuse. While no system is completely secure, we work to safeguard the information you entrust to us.

8. How long we keep your information

We keep your personal information only for as long as necessary to fulfil the purposes described in this policy, to provide our services, and to comply with our legal obligations, after which it is securely deleted or anonymised.

You have the right to request access to the personal information we hold about you; to request that we correct or delete it; to object to its processing in certain circumstances; to withdraw your consent where processing is based on consent; and to lodge a complaint with the Information Regulator.
